Terms of Use

Deskmate is a free macOS application made by Huu Nguyen ("we", "us"). By installing or using it, you agree to these terms. If you do not agree, please do not use the app.

1. Your licence

Deskmate is free. We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use it on Macs you own or control, for personal use and for ordinary use at work.

You are buying nothing and we are selling nothing. No fee is charged now, and if that ever changes, it will not change for a copy you already have.

2. What you may not do

Deskmate is closed-source software. You may not:

• copy, redistribute, sell, rent, sublicense or publish the app or any part of it
• reverse engineer, decompile or disassemble it, except where the law says you may regardless of this clause
• remove or alter any copyright or identification notice
• present the app, or anything derived from it, as your own work

3. Ownership

Deskmate, its source code, design and artwork stay ours. These terms give you permission to run the app, and nothing more.

Third-party components inside Deskmate remain under their own licences and belong to their respective owners.

4. Your files and your machine

Several parts of Deskmate act on your own computer, and you stay in control of what they do:

• Clean Up finds files it believes are disposable and, when you confirm, moves them to the Trash or deletes them permanently if you have opted into that. Only you know what matters on your Mac. Review the list before confirming, and keep backups.
• Developer Runtimes can change which version of a runtime your version manager treats as the default, and can install new versions through that manager. Each change is shown to you before it happens.
• Window management moves and resizes windows belonging to other applications, using the Accessibility permission you grant in System Settings.
• Screen capture records the contents of your screen when you ask it to.

You are responsible for the choices you confirm. We are not responsible for files removed, configurations changed, or work lost as a result of them.

5. The VPN module

Deskmate contains a VPN client. It is not a VPN service.

We do not operate VPN servers, and no traffic of yours passes through infrastructure we control. Deskmate connects to servers you choose, using configuration you supply, and any relationship you have with the operator of such a server is between you and them.

You are responsible for using the VPN lawfully where you are, and for anything you do through it. Where the app helps you reach a third-party network (for example Cloudflare WARP, or a public server list), that provider's own terms and privacy policy apply to your use of it, not ours.

6. Third-party services

Deskmate can contact a small number of outside services on your behalf, and only when a feature that needs one is used. Which ones, and what leaves your Mac, is set out in the Privacy Policy. Those services are run by other people, and we do not control them or answer for them.

7. Updates

Deskmate can check for new versions and install them, through Sparkle. You can turn automatic checks off in the About window at any time. We may change, add or remove features between versions, and we are not obliged to keep any particular feature or to keep supporting older versions of macOS.

8. No warranty

Deskmate is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not promise that the app will be uninterrupted, error-free, compatible with your setup, or that it will not lose data.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for lost data, lost profits, or business interruption, arising out of or connected with your use of Deskmate, even if we have been told such damage is possible.

Where liability cannot be excluded, it is limited to the amount you paid us for the app, which is zero.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

10. Ending this licence

You may stop using Deskmate at any time by deleting it. Your licence ends automatically if you breach these terms, and clauses 3, 8 and 9 survive that.

11. Changes to these terms

We may update these terms as the app changes. The current version is always the one in the app, under About, and at the address in clause 12. The date at the top says when it last changed. Continuing to use Deskmate after a change means you accept the new terms.
